The parties, Import Supplies Direct limited (hereinafter referred to as the vendor) and the customer (purchaser) will be deemed to have entered into a mutually legally binding contract for the vendor to sell the goods and the purchaser to buy (and pay for the goods) including all delivery charges once an order has been placed and confirmed.  Confirmation will normally be by automated e-mail.

This contract may be severed by either party within 30 calendar days by either party as set out below in our 30 day money back guarantee:-

The contract between the vendor and the purchaser shall be deemed to be cancelled if:-

The customer changes their mind and successfully returns the goods in saleable condition together with original packaging and pays for all packing and delivery charges.  Where delivery is offered free of charge or at a discounted rate by the vendor the actual cost of packaging and delivery as incurred by the vendor will still be payable.  The vendor will not, in any circumstances be responsible for the logistics of arranging returned goods to be collected.

The customer receives goods (or the first attempt at delivery by the courier) is more than seven days later than advertised delivery time or if goods are not of merchantable quality or fit for the purpose for which they were sold (as advertised within the on-line shop where they were bought).   In such an eventuality  the vendor will be responsible for all packaging and delivery charges both ways.

The goods are out of stock and an alternative that is acceptable to the purchaser cannot be found.

Refunds under the 30 day money back guarantee shall be initialled by the vendor NOT the customer.  Should the customer initiate a credit card charge back, cancel a cheque, revoke a Paypal or other method of payment this will be regarded as breach of contract and / or fraud by the customer who will thereafter remain liable for payment as specified in English law and the terms of this contract and the rights to the 30 day money back guarantee, described above, shall be revoked.  This clause is included so as to give the vendor opportunity to verify the delivery charges if applicable, the status of delivery and the condition of any returned goods.

Limitation of liability.

By entering into this contract the purchaser agrees to relinquish the vendor from any consequential losses or damages howsoever caused, pertaining to the condition, and suitability of goods including timing of delivery, stock availability or other factors.  In any event the vendor’s liability shall be limited to the purchase price of the goods and delivery charges where applicable.

Charges for site visits.

Should the customer purchase DIY Basement Wateproofing products through this site and, at any time before or after such a purchase solicits a site visit (free of charge or fee paying) from our sister site www.polycrete.co.uk   or www.basementsystemsltd.co.uk the customer shall be liable for the site visit charge as set out in our complete DIY waterproofing package, whether or not the customer has selected this option.  In the event that a fee has been paid for such a site visit, this will be deducted from the amount payable as specified in our DIY basement waterproofing listing within this site.

Capacity of pumping systems.

Customers should be aware that ALL pumping systems have a finite capacity and should water flows exceed this capacity the vendor shall not be liable for any consequences arising.
